Kerrville lawyers dismissed from developer's suit
By Zeke MacCormack - Express-NewsRichard and Dixon Mosty, father-son lawyers from Kerrville, have been dismissed as defendants in a federal lawsuit filed by Andy Phillips Sr., a developer there.
U.S. District Court Judge Harry Lee Hudspeth ruled Thursday that they are immune from liability since their alleged acts occurred as lawyers for Herb Williamson, who was a partner of Phillips in a defunct development there called Keystone Estates Inc.
Williamson sued Phillips in Kerrville in 2010 over misspent funds. Phillips, after countersuing, filed a federal suit that includes as a defendants District Attorney Amos Barton, who's accused of malicious prosecution.
