Woman accused of sexually assaulting 13-year old

San Antonio police Monday night arrested a woman accused of sexually assaulting a 13-year-old boy.

Amanda Ann Nabers, 25, was set to be booked in Bexar County Jail on one count of aggravated sexual assault of a child. A judge set bail at $50,000.

A Texas Department of Family and Protective Services caseworker with Child Protective Services told police Nabers had endangered her own children and engaged in sexual activities with the boy, according to an arrest warrant affidavit.

Man gets life without parole in double killing

A truck driver from Tyler was ordered Tuesday to spend the rest of his life in prison for killing his newlywed wife and her co-worker inside a San Antonio Dollar General store days after she announced intention to get an annulmen.

Jurors deliberated about two hours before finding Alonso Mendoza, 33, guilty of capital murder for the July 1, 2009, slayings of Misty Espinoza, 25, and Clarence Blades, 40, who she was dating.

Because prosecutors weren't seeking the death penalty, state District Judge Juanita Vasquez-Gardner had only one sentencing option: Life in prison without parole.

Juror attempts to "friend" defendant on Facebook

FORT WORTH, Texas - When you're trying to decide the guilt or innocence of someone on trial, it's probably not a good idea to 'friend' that person on Facebook.

The Fort Worth Star-Telegram reports 22-year-old Jonathan Hudson was removed from a jury last month after trying to add the defendant as a Facebook friend.

The civil trial was over a 2008 car wreck and proceeded with 11 jurors.

A school principal was charged with one count of indecent exposure after his arrest by an undercover San Antonio police officer at Olmos Basin Park on Monday.

Kenneth Elton Whiteker, 63, was released around 8:50 p.m. Monday after posting $1,600 bail.

An incident report states Whiteker, who retired from Pleasanton Independent School District in July 2007, was in his parked vehicle around noon with the window down when an undercover officer approached him.

Firefighters battle blaze, intense heat in Canyon Lake

A fire burned out of control Saturday, torching trees and heating rocks in a Canyon Lake area neighborhood, a fire department spokesman said.

Firefighters battled the blaze in two waves ending after 6 p.m., said Capt. Justin Lowth of the Canyon Lake Fire Department. He said no one was hurt.

Man threw 7-year-old son overboard for crying, authorities say

Two Orange County boys were in the custody of their mother Tuesday after their father was accused of throwing his 7-year-old son overboard from a boat after the boy would not stop crying, authorities said.

Sloane Briles, 35, of Irvine was booked on suspicion of child endangerment and resisting arrest. He was released Monday after posting bail.

Briles and his girlfriend were aboard the tour boat Queen on a cruise of Newport Harbor just before 2 p.m. Sunday when the couple got into an argument in front of his 6- and 7-year-old sons from a previous marriage, said Orange County sheriff's spokesman Jim Amormino.

Glendale family arrested in alleged shoplifting incident at Sears
LA Times -


A Glendale family of four --including two teenage sisters -- were arrested over the weekend after they attempted to steal about $550 worth of shoes and cologne from a Sears store in Burbank, police said.

Christian Gonzalez, 31, and his wife, Norma Gonzalez, 32, along with their 13- and 14-year-old
daughters were arrested outside the store on Magnolia Boulevard after employees stopped them and said they were placing shoes and boxes of cologne into bags from another store, Burbank Sgt. Travis Irving said Monday.

The incident occurred at 7:50 p.m. Saturday, Irving added.

CENTRE HALL, Pennsylvania (AP) — A couple of Pennsylvania newlyweds are behind bars after police say they were caught shoplifting food from a supermarket for their wedding reception.

The Centre Daily Times reports 32-year-old Arthur Phillips III and his bride, 22-year-old Brittany Lurch, were arrested Saturday after taking more than $1,000 in merchandise from a supermarket in the town of State College.

Patton Township police say the couple was captured on surveillance footage loading a shopping cart and leaving the store without paying.

Drug deal gone awry?

Speculation on the News this morning was that this may have been a drug deal gone sour.


1 killed, 1 injured in shooting on Northeast Side

One man was dead and another was shot in the head, but still conscious, at a Northeast Side apartment complex Sunday night.

The 27-year-old man shot in the left eyebrow was sitting at the living room table smoking a cigarette when emergency responders arrived at the third-floor apartment in the 6000 block of Randolph Boulevard, San Antonio police Sgt. Steve Herries said.

"He had a hole in the head but didn't appear to be bleeding," Herries said. "EMS was in a big hurry to get him out of there, but he was sitting and walking."

Woman found dead on I-35 in Schertz

Authorities are investigating the death of a 21-year-old woman from New Braunfels who was found dead in the median of Interstate 35 in Schertz early Sunday.

Around 7 a.m., a motorist spotted the woman's body in the middle of the median on I-35, near FM 2252, and called 911. Officials have not yet released her name, pending notification of her next of kin.

Schertz police spokesman Brad Bailey said the woman was fully clothed, wearing tight jeans and high-heeled shoes, in the middle of the median. She was pronounced dead at the scene.

Hammer-wielding robbery suspect shot in the buttock

A robbery suspect at a Shell gas station on the city's Northwest Side wound up being shot in the buttock Sunday night by a customer who was a licensed hand gun owner.

The suspect, 35-year-old Dustin Darsp, entered the station store in the 10100 block of Culebra Road with what appeared to be a handgun, San Antonio police Det. Roberto Bernal said. Really, it was a hammer no more than 6 inches long, draped in a black cloth or sock.

“He carried it as if it was a gun and pointed it at the clerk and the customer, who was a licensed handgun owner,” Bernal said. “He wanted them to believe that what he had was a gun.”

Sheriff's patrol car knocked over cliff, 2 Deputies injured

A Los Angeles County sheriff's patrol car was struck from behind by a car with an alleged drunken driver at the wheel, knocked off Pacific Coast Highway and landed on a Malibu beach Saturday morning, injuring both deputies inside.

The patrol car landed upright, with its front end in the sand, and all of its doors jammed. Firefighters worked in ankle-deep water with hydraulic cutting tools to get the deputies freed from the wreckage, as the front doors were apparently jammed shut.

The deputies, 51-year-old Jeffrey Miner and 47-year-old James Millage, were taken to the Ronald Reagan UCLA Medical Center, said Lt. Stephanie Shrout of the sheriff's Lost Hills station.

He could count to 25!!

Yoandri Hernandez Garrido's nickname comes from the six perfectly formed fingers on each of his hands and the six impeccable toes on each foot.

Hernandez is proud of his extra digits and calls them a blessing, saying they set him apart and enable him to make a living by scrambling up palm trees to cut coconuts and posing for photographs in this eastern Cuban city popular with tourists. One traveler paid $10 for a picture with him, Hernandez said, a bonanza in a country with an average salary of just $20 a month.

"It's thanks to my 24 digits that I'm able to make a living, because I have no fixed job," Hernandez said.

Counterfeit $100 bills spur probe in Kerr County

KERRVILLE — Three phony $100 bills that surfaced in Ingram this month have prompted an investigation by the Secret Service and Kerr County authorities.

“We’ve got some good leads we’re working on,” Sheriff Rusty Hierholzer said of the case, in which two bills were successfully passed and a third was declined by the same merchant.

He said the specialized pens often used by merchants to detect bogus bills don’t work on the phony $100 bills because they were created by copying the $100 bill image onto $5 bills whose ink had been bleached out.

Bexar County deputy constable killed in fiery crash

A Bexar County deputy constable died Saturday night in a fiery crash on the Northwest Side.

Traffic investigators working in the early hours Sunday had little indication of what caused the collision reported shortly before 10:30 p.m. at the intersection of Lockhill-Selma and George roads. They were not releasing any information on the victim, pending an investigation by the Medical Examiner's Office and notification of family members.

Bexar County sheriff deputies were alerted the officer was in trouble when the emergency button in the Precinct 3 constable vehicle was activated, and a call from the San Antonio Police Department reported that a deputy had been involved in a wreck, said Deputy Chief Dale Bennett, a spokesman with the Bexar County Sheriff's Department.

Astronomers discover planet made of diamond

(Reuters) - Astronomers have spotted an exotic planet that seems to be made of diamond racing around a tiny star in our galactic backyard.

The new planet is far denser than any other known so far and consists largely of carbon. Because it is so dense, scientists calculate the carbon must be crystalline, so a large part of this strange world will effectively be diamond.

"The evolutionary history and amazing density of the planet all suggest it is comprised of carbon -- i.e. a massive diamond orbiting a neutron star every two hours in an orbit so tight it would fit inside our own Sun," said Matthew Bailes of Swinburne University of Technology in Melbourne.

Salesman gets probation for Rackspace fraud

A former salesman for Rackspace Managed Hosting was sentenced Thursday to two years of probation for defrauding the San Antonio company out of $64,174.

David John Whitman pleaded guilty in May to two counts of wire fraud. He admitted turning in fraudulent service orders so he could get higher commissions.

Whitman faced up to a year in jail on each count, but brought a $5,000 check to apply to restitution and help boost his chances for probation.

Perhaps Mexico needs to have a death penalty, at least for crimes of mass murder such as this.

The country really needs to get control over this.  Apparently the attack is being attributed to a drug cartel.

MONTERREY, Mexico (AP) — The death toll climbed as workers continued to pull bodies out of a burned casino in northern Mexico, where gunmen spread gasoline and ignited a fire that trapped and killed at least 53 gamblers and employees.

Family members gathered at the caution tape outside the Casino Royale after the Thursday afternoon fire in the northern industrial city of Monterrey, some crying and others yelling at police for providing no information.

Later they were allowed to view bodies in the morgue to help identify the victims.

Francisco Tamayo, 28, of Monterrey, said he and family members looked at some 40 bodies in search of his mother, Sonia de la Pena, 47, who loved to gamble at the casino and was there on average four days a week. They had yet to find her.

SHELBYVILLE, Ky. — Jurors rejected a truck driver’s claim for $16 million in damages after part of his penis was amputated because they believed the doctor saved the man’s life, the jury forewoman said in an interview Wednesday.


After only about an hour of deliberation Wednesday, the six-man, six-woman jury in Shelby County Circuit Court found that Dr. John Patterson acted appropriately and Phillip Seaton, 64, of Waddy, should get no money in the lawsuit.

“We felt bad for the circumstances. (Seaton) has our sympathy. But at the same time, he’s alive today because this man did what he did, because this man performed the surgery,” jury forewoman Lydia Tapp told The Courier-Journal in a phone interview.

Suspect found hiding in Dry Comal Creek

NEW BRAUNFELS — Officers serving a warrant on a man in New Braunfels surrounded an area of Dry Comal Creek, where they found the suspect hiding Wednesday morning and arrested him, police said.

Officers in at least eight police vehicles assisted in the 11:45 a.m. capture of the 36-year-old shirtless man. The officers set up a perimeter during the nearly two-mile chase and slowly closed it until they caught the man, said Sgt. Chris Peltier of New Braunfels Police Department.

Woman found dead in car trunk

A woman was found dead Wednesday inside the trunk of a vehicle parked in a West Side neighborhood.

Authorities found the decomposing body shortly before 2 p.m. in a maroon Ford Thunderbird abandoned near the corner of 26th and Ruiz streets.

The vehicle and its owner had been reported missing over the weekend, and investigators were working to identify the body but could not yet confirm if she was the missing owner, said Sandy Gutierrez, a San Antonio Police Department spokeswoman.

BRISTOL, Tenn. (AP) - Police in Tennessee were called to a funeral home where workers found two intruders sleeping inside caskets.

The employees at Weaver's Funeral Home in Bristol called police around 10:30 a.m. on Tuesday after finding two men asleep in caskets. The men fled through a window after police were alerted, the Bristol Herald Courier reports.

One man escaped, but police caught and arrested Barrett Lance Hartsock, who was charged with burglary and vandalism over $1,000.

A woman encouraged her husband to have sex with a 12-year-old girl so that she would get pregnant and they could claim extra cash benefits.

Alicia Bouchard even sat and watched while her 26-year-old husband had sex with the underage girl at their Florida home.

According to an arrest warrant, the 41-year-old wanted the girl to fall pregnant so that she and her husband would have extra income from state benefits.

Judge sets January execution date in S.A. killing

An execution date of Jan. 26 has been set for Rodrigo Hernandez, a death row inmate convicted by a Bexar County jury in 2004 of raping and strangling a single mother whose body was found stuffed into a 55-gallon trash can behind a West Side church.

State District Judge Angus McGinty approved the date last week without a hearing.

The 1994 slaying of Susan Verstegen, 38 a Frito-Lay saleswoman who disappeared during a late-night shift, went unsolved for eight years. Investigators focused on Hernandez, 38, only after he gave a DNA sample to Michigan prison authorities as he was set to be released there on an unrelated charge.

Man accused of wounding cop is back in S.A.

A man arrested in Baton Rouge, La., last month, accused of fleeing there after a shoot-out with a San Antonio police officer, was transported to Bexar County early Tuesday, officials said.

Rafael Gonzalez Sanchez, 40, is being held without bail in Bexar County Jail on one count of attempted capital murder of a police officer.

He was arrested at The Shades Motel in Baton Rouge on Aug. 2, two days after he reportedly shot Officer Leroy Diaz in the leg outside Sanchez's home in the 15000 block of Beavers Run.

FRESNO, Calif. (AP) — Somewhere in California, someone has a truck load of stolen merchandise that probably is starting to stink.

What's believed to be the first-ever large-scale theft from a fish hatchery in the state has wardens from the Department of Fish and Game scouring markets and roadside stands looking for thousands of pounds of trophy-sized trout.

Workers on Sunday arrived at the San Joaquin State Fish Hatchery to find the gate pried open, blood covering the floors and 70 dead trout left behind. Department spokesman Patrick Foy said as many as 1,000 trophy trout were stolen.

A Mexican orthodontist who set up shop in the San Antonio area without a state license was ordered to serve probation Monday after showing up in court with more than $30,000 in restitution for his patients.

Julio De La Fuente, 55, pleaded no contest in May to practicing dentistry without a license. As part of a plea agreement, prosecutors agreed to ask state District Judge Juanita Vasquez-Gardner for a term of no more than five years.

Citing the substantial restitution payment, the judge agreed with defense attorney Tylden Shaeffer that De La Fuente should receive a second chance with 10 years of deferred adjudication probation. Vasquez-Gardner also ordered 500 hours of community service.

Intruder shot in North Side home

A homeowner shot an intruder who kicked in the door of a North Side home early Monday afternoon, San Antonio police said.

A man in his 30s had been sleeping upstairs when he awoke to someone pounding on the front door of his home in the 300 block of Country Wood Drive, police spokesman Officer Matthew Porter said.

The homeowner looked through the peephole and asked the man at the door what he wanted, but the man ignored him and kicked the door open, police said.

The cans are banned

So, its come to this.

An outright ban of all disposable containers on the rivers in New Braunfels.

Folks you did it to yourselves by your irresponsible and often feckless behavior in tossing cans, bottles and who knows what into the rivers when you tube.



Council bans beer cans on Comal and Guadalupe

NEW BRAUNFELS - In a move to keep the Comal and Guadalupe rivers from being trashed-out by tubers, New Braunfels City Council on Monday banned beer cans and other disposable containers on the rivers beginning Jan. 1, 2012.

The ban was approved - on a 5-1 vote - after one protester had been arrested, another had thrown a volleyball-sized wad of dollar bills at the council, a lawsuit had been promised, and citizens had paraded to the podium for an hour to express their support or opposition. Councilor Steven Digges was the dissenting vote. Councilor Richard Zapata was unable to attend Monday's meeting.

'Stick-up man' charged in pregnant teen's slaying

Authorities have charged an 18-year-old man with fatally shooting a pregnant teenager whose infant son was delivered by doctors in an emergency procedure.

Prosecutors on Sunday charged Timothy Jones, 18, with first-degree murder in the Aug. 16 shooting death of Charinez Jefferson, according to Chicago police.

Jones, of the 6300 block of South Rockwell Street, is expected to appear before a judge Monday afternoon.

Man charged in July beating of friend

A 22-year-old man was arrested Sunday morning after being charged with striking another man with a hard object last month.

Jose Jaime Frausto was charged with aggravated assault, causing serious bodily injury to a friend, Christopher Mendoza, 22, an arrest warrant affidavit states.

The two men were drinking at Frausto's apartment in the South Side in mid-July around 2:45 a.m., when they got into an argument, according to the affidavit. Mendoza began walking home because he did not want to speak with Frausto and was also asked to leave.

I guess he went back to school shopping

Holy smokes they are lucky they weren't killed.

This incident is Exhibit A in why I avoid North Star Mall like the plague.

Kudos to the police officers who recognized him from the video tape the following day.


Man accused of robbing couple at North Star Mall at gunpoint

San Antonio police Saturday night arrested a man suspected of trying to rob a couple at gunpoint and shooting one victim in a parking garage at North Star Mall.

Derrick Woolridge, 29, is being held in Bexar County Jail on one count of aggravated robbery. A judge set bail at $75,000.

How long now before the Manhattan District Attorney's Office drops the criminal charges?

I mean if she is now willing to drop the charges if she is givene money how likely is her version of the events now?


Strauss-Kahn accuser mulls dropping case for money: report

(Reuters) - Lawyers for the woman who accused former IMF chief Dominique Strauss-Kahn of sexual assault have explored a deal in which they would scuttle the criminal case in exchange for a monetary settlement in the civil lawsuit, the Wall Street Journal reported on Friday.

The woman's lawyer, Kenneth Thompson, strongly denied the report, which the Journal sourced to unidentified people briefed on the matter.

The report comes ahead of Tuesday's scheduled court hearing in which Strauss-Kahn, once seen as a leading contender to be the next president of France, was due to appear before a judge for the first time since he was freed from house arrest on July 1.

A San Antonio man was charged Friday with theft of federal property after he admitted burglarizing the vehicle of a deputy U.S. marshal and stealing a bag containing his raid and tactical gear.

Francisco Castro Jr., 28, told law officers his initial intent was to burglarize a car that was parked at a home on West Martin Street, not knowing it belonged to a federal marshal, according to a criminal complaint affidavit.

Castro took a bag that contained the deputy marshal's federally issued bullet-resistant vest, tactical vest, raid jacket and overcoat, tactical belt ensemble, boots and clothing, the affidavit said.

220 years handed out in porn case

A San Antonio man convicted by a jury in June of downloading hardcore prepubescent child pornography was ordered Friday to serve 220 years in stacked sentences — one of the longest punishments prosecutors said they could recall, locally or elsewhere.

Paul Joseph Lamarre, 43, initially faced up to 10 years in prison for each of the 22 counts of possession of child porn. But convictions related to child exploitation and molestation are among the few crimes in Texas that judges are allowed to stack.

Prosecutors in Bexar County tend to ask for consecutive sentences only in “extraordinary” circumstances, and this one qualified as such, Assistant District Attorneys Patrick Ballantyne and Stephen Ahl said after state District Judge Maria Teresa Herr announced her decision.

2 drunken driving arrests for MD. mom in 3 hours

SALISBURY, Md. (AP) — A Salisbury woman has been arrested twice in three hours on drunken driving charges, and police say she had her 4-year-old daughter with her the second time.

An officer stopped Ann Marie Abdullin on Route 50 in Salisbury early Tuesday for traffic violations, and police say she was impaired by alcohol.

Authorities say they learned Abdullin, 23, had been arrested just three hours earlier on a drunken driving charge and released to a sober driver.

Espinoza last was seen on the haunting, silent video getting pushed by her newlywed husband to an area off-camera as she tried to back away.

A Bulverde man who said he was “director of rangers for the republic state of Texas” was held on $30,000 bail at Bexar County Jail on Thursday on charges of impersonating a peace officer and unlawfully carrying a weapon.

Gregory B. Davis — wearing a badge and carrying a gun — used his claimed position to gain free entry to a rodeo July 31 in Helotes, according to authorities, who say firearms were restricted because alcohol was being served.

“This guy's been putting himself off as a ranger for at least several months,” Texas Ranger James A. Scoggins said of Davis, 61, who was arrested Wednesday.

Guilty plea entered in child porn case

NEW BRAUNFELS — A New York woman pleaded guilty Thursday in a Comal County court to five counts of promotion of child pornography and was sentenced to 15 years in state prison.

Anita Martinez, 25, entered into an online relationship with Stephen Michael Hall, 33, of New Braunfels, and sent him five pornographic images she created of a toddler, said Jennifer Tharp, Comal County criminal district attorney. She said Martinez then brought the girl to New Braunfels.

Despite causing controversy last month with a video that portrayed white middle class Americans as the most likely terrorists, the Department of Homeland Security has released yet another PSA that depicts an attempt to bomb a subway station not by Al-Qaeda Muslims, but well-dressed white people.

A new Public Service Announcement entitled ‘The Drop Off – If You See Something, Say Something’ was unveiled by none other than Big Sis herself, Janet Napolitano, on the Homeland Security website today.

The PSA, which will be played on television and radio stations, shows a well dressed attractive white woman exiting a taxi before walking into a subway station. The taxi driver – a white man – then makes a phone call and sets a timer on a device in the trunk of the car. The woman then leaves her bag in the station.

Trial set over KY doctor's amputation of penis

SHELBYVILLE, Ky. (AP) — The dispute between a Kentucky man and a surgeon over the necessity of amputating the patient's penis during surgery in 2008 is set to go to trial this week.

The doctor maintains he found cancer in the man's penis during surgery and that it had to be removed, according to the physician's attorney. The patient claims the surgery was supposed to be a circumcision and he never authorized the amputation, nor was he given a chance to seek a second opinion.

Jury selection begins Thursday in the lawsuit brought by Phillip Seaton of Waddy and his wife, Deborah, against Dr. John Patterson of Louisville. Attorneys hope to start opening statements that afternoon.

Suit dismissed

I would think there is more to this dismissal other than the boy wasn't on US soil when he was shot.

It certainly wouldn't be the first time a reporter or paper misunderstood a judge's ruling.


Texas Judge throws out suit in Mexican boy's death

EL PASO, Texas (AP) — A judge in West Texas has dismissed a $25 million wrongful death lawsuit brought by the family of a 15-year-old Mexican boy killed by a Border Patrol agent.

Senior U.S. District Judge David Briones on Aug. 11 threw out the lawsuit against the U.S. government over the June 7, 2010, shooting of Sergio Adrian Hernandez Guereca on the Mexican side of the Rio Grande.

The El Paso Times (http://bit.ly/rmUHwn ) reports Thursday that Briones dismissed the case because the boy was not shot on U.S. soil.

Going for a third time?

Man want's retrial in boy's death

NEW BRAUNFELS — A Canyon Lake man convicted of manslaughter several years ago after a pickup crash killed a boy getting off a school bus was in court this week seeking another retrial.

Jurors did not reach a unanimous decision in March 2007 against Roy Mack Miller Jr., 74, who was convicted in his second trial in June of that year, sentenced to 11 years in prison, and had a request for a new trial denied in August 2007. He went before District Judge Jack Robison with claims Tuesday that his trial attorney was inept, leading to Miller’s conviction on charges he ran down 12-year-old Ryan Padilla in December 2005.
