Murder suspect says victim was choking him

As Richard Daniel Simmons stabbed a fellow diner at least 18 times in a Mexican restaurant bathroom almost three years ago, the stranger continued to goad him with profanities and choke him, the murder defendant told a jury Wednesday.

“When I was blacking out (from being choked), I was terrified for my life,” Simmons testified. “I just tried to push him away. I didn't think I was really stabbing him, but there's not much room.”

Antonio “Tony” Herrera, 38, died several days after he was found inside the small Las Palapas bathroom at about 1 a.m. on Sept. 16, 2007.
