Surgery

Leaving for the hospital in a few minutes its about 4:50 a.m. in the morning here.

I am having carpal tunnel surgery to my other hand, the left.  The right was done several weeks ago.

Posting may be light to non-existent for the next few days.  please check in from time to time.

Judge in Hasan case removed

An appeals court in Washington on Monday removed the military judge overseeing the trial of an Army psychiatrist accused of killing 13 people in the 2009 Fort Hood shooting spree.

The U.S. Court of Appeals for the Armed Forces was expected to rule on a long-disputed order requiring Maj. Nidal Hasan to shave his beard, which he grew in violation of Army regulations.

Instead, it sidestepped the issue after finding that the judge, Col. Gregory Gross, had displayed an “appearance of bias” in the case. The Army's judge advocate general will appoint a new judge.

Parents seek charge upgrade in fatal DWI crash

Weeks after a pickup driven by a suspected drunken driver claimed his son's life, Jerry Tegel hopes authorities will upgrade the charge against him.

Joshua Tegel, 16, was walking with friends down Gibbs-Sprawl Road near Castle Cross at about 8 p.m. on Nov. 17 when he was hit from behind by a Ford Ranger. He died at the scene.

The driver, Royce Alvin Willis, 39, told police he had slowed and moved to the side to let two vehicles pass him and when he pulled back into the road, Tegel was in his path.

SAPD asks state for DWI checkpoints

AUSTIN — Citing a troubled culture that fuels drunken driving, a San Antonio Police Department deputy chief urged legislators Monday to consider establishing permanent sobriety checkpoints across Texas.

“We really do need to make a cultural change in the state of Texas when it comes to driving under the influence of alcohol,” Deputy Chief Anthony Treviño told the Texas House Criminal Jurisprudence Committee.

In asking that law enforcement agencies be able to stop drivers and conduct routine sobriety tests near drinking-and-driving “hot spots,” Treviño said local data could be used to identify areas where such behavior is prevalent.

Small Employers weigh impact of providing health insurance

Like many franchisees, Robert U. Mayfield, who owns five Dairy Queens in and around Austin, Tex., is always eager to expand and — no surprise — has had his eyes on opening a sixth DQ. But he said concerns about the new federal health care law had persuaded him to hold off.

"I'm scared to death of it," he said. "I'm one of the ones sitting on the sidelines to see what's really going to happen."

Mr. Mayfield, who has 99 employees, said he was worried he would face penalties of $40,000 or more because he did not offer health insurance to many of his full-time workers — generally defined as those working an average of 30 hours a week or more. Ever since the law was enacted in 2010, opponents have argued that employers who were forced to offer health insurance would lay off workers or shift more people to part-time status to compensate for the additional cost. Those claims have drawn considerable attention — and considerable anger in response — in recent weeks.

Tax hitmen to track your spending

Credit reference agencies will cross-check details of the income people declare on their tax returns against their spending patterns to identify “high” and “medium” risks of both illegal and legal tax avoidance.
People identified to HM Revenue and Customs will then be subject to more detailed investigations. About two million people are expected to be scrutinised under the programme, which may lead to privacy concerns.

HMRC will today unveil the “successful” results of a pilot programme involving about 20,000 people which will now be extended nationally.

Young 'superhero' gets bedroom to match

Daniel Adair is a 6-year-old who has undergone three surgeries to treat a heart condition he was born with, but that hasn't kept him from dreaming of being a cowboy or of superheroes.

So a group of local volunteers with the nonprofit Wish Connection raised enough money in donations to have Daniel experience his dream this weekend — visiting Candlelight Ranch in the Hill Country, where he enjoyed dinner and music around a campfire with several cowboys and cowgirls from the surrounding area.

Daniel and his family also got to ride a steam train in Austin on Sunday before returning home to find that the volunteers also had redecorated his room with a superhero theme. Iron Man and various characters from Marvel Comics adorn the walls of the room, with new wood floors and furniture that was donated by various businesses.

Brothers accused of shooting cousin

San Antonio police late Saturday arrested two brothers, accused of shooting their cousin on the West Side.

Paul Garcia, 27, and Gus Garcia, 22, were both charged with aggravated assault with a deadly weapon in connection with the October shooting and held on $75,000 bail. While the younger brother had posted bail Sunday afternoon, Paul Garcia remained at the Bexar County Jail.  According to arrest warrant affidavits, cousins Paul Garcia and Carlos Moya both had dated the same woman, and each man has a child with her.

Moya told police his cousin threatened to kill him, his son and his son's mother in a text message, and then Paul Garcia arrived at Moya's son's house with a gun.

Teacher's reward program charges second-graders for bathroom breaks

The mother of a 7-year-old Irving elementary school student says her son wet his pants in class after his teacher refused to let him use the restroom Thursday afternoon.

"I was absolutely appalled," Sonja Cross said. "I could not believe it."

The first-year teacher at J.O. Davis Elementary awards her students with "Boyd Bucks" for good behavior. Going to the bathroom outside of the three scheduled breaks costs two Boyd Bucks per trip.

Police say woman shot husband after argument

A woman shot her husband Saturday night on the West Side after they had an argument, police said.

The couple were fighting in the 500 block of Upland Creek about 9:30 p.m. when she grabbed a handgun and shot him in the side, SAPD Sgt. Steve Almanza said.

The man was taken to a hospital by EMS, but his injuries were not considered life-threatening, Almanza said.
The woman fled, and police were still looking for her as of 10:30 p.m.

Movie theater evacuated after bomb threat

A bomb threat prompted the evacuation of a downtown movie theater Saturday night. Around 8 p.m., San Antonio police were called to the AMC Theater in Rivercenter Mall to investigate a bomb threat, a department spokesman said.

Officers helped to evacuate the theater and searched it for anything suspicious, but nothing was found.

Although police allowed patrons back inside the theater, management opted to close for the night.

Police: Chiefs player kills girlfriend then himself
KANSAS CITY, MO (KCTV) - 

Police are investigating two deadly shootings Saturday morning that they said are related.

The shootings involve a Chiefs player and his girlfriend.

The first shooting was reported about 8 a.m. at a home near East 54th Terrace and Crysler Avenue. The second shooting was reported a short time later at a Chiefs practice facility located on the Arrowhead facility.

Wanted gangster in U.S. custody

A long-sought American gangster known for flashy cars, flipping off the feds and fleeing south of the border has been captured in Mexico and sent back to the United States.

Federal agents have been chasing Raul Sergio Madrigal since 2009 when — apparently spooked by pending charges — he ran away to Mexico and left behind his stable of BMWs, Maseratis, a Bentley and a Hummer.

Authorities contend Madrigal, 33, is a member of the largest gang in Texas and ran a major drug-distribution network for the Gulf Cartel.

He is in U.S. custody after being snagged near Monterrey, Mexico, authorities said Friday.

Guilty verdict in fatal carjacking

A San Antonian whose capital murder charge was reduced because of his age was found guilty by a jury Friday of first-degree murder in a fatal carjacking attempt five years ago.

Aaron Alaniz, now 21, was 16 in August 2007, when prosecutors said he shot Vicente Alvarez Huerta — a stranger who was driving home in his prized Ford Expedition from a day of work at Santa Maria Mexican Restaurant, his family's business.

The defendant has opted to have state District Judge Angus McGinty determine his sentence early next year instead of a jury. He faces up to life in prison, with the possibility of parole after either half the sentence is served or 30 years.

Castilleja receives 99 years for sexual assault

NEW BRAUNFELS — A Comal County jury of six women and six men on Thursday sentenced a New Braunfels child molester to 99 years in prison.

His conviction also means Armando Castilleja, 53, is required to register as a sex offender for the rest of his life.


Before jurors began deliberating Castilleja’s punishment, Laura Bates, Comal County assistant district attorney, said the only way to send a message to him and other pedophiles was to sentence Castilleja to life behind bars.
