If he was properly Mirandized then I do not see why his statements would not be admissible as admissions against interest.
Police: Money for abortion was motive
The teen accused of slaying restaurateur Viola Barrios said he burglarized her home because he needed $300 to pay for an abortion for his girlfriend, a detective revealed Tuesday during a pretrial hearing in his capital murder case.
The detail came as defense attorneys for Joe Estrada Jr. asked state District Judge Maria Teresa Herr to throw out the statement — and others — before a jury hears the case.
Estrada's trial, which could result in the death penalty, is scheduled to begin in January. Herr is expected to rule on the motions on the admissibility of his statements next week.
