Wade or Rust?

The wonderful choice for the citizens living in Comal County JP Precinct #3

The citizens who reside in Comal County Justice of the Peace Precinct #3 are facing an embarassment of richness this election cycle.  One that many other communities around Texas and the rest of the Country wish they had.

Two very good individuals to choose from for Judge in the JP #3 race here in Comal County.

A brief disclaimer.  I know both men, and consider them to be friends of mine.

Wade Arledge, the Democrat, is a criminal defense attorney who is passionate about the constitutional rights of defendants however he is also sensitive to the plight of the victims of crime.  He will bring legal acumen to the bench (a JP Judge in Texas does not have to be an attorney however) and all who would appear would be given a fair trial and the opportunity to be heard.

Mike Rust, the Republican, is a former Lieutenant who retired two or so years ago from the New Braunfels Police Department.  When I first met Mike in 2005, he was the head of CID (Criminal Investigations Division) at the PD.  I was doing, as part of my job, the felony intake and preparing matters to present to the Grand Jury.  Mike ran a very professional department; I was impressed at the high level of work product that came out of it.  (To be frank, I was a little surprised, having come from Bexar County, I expected a more mundane department in a small county)  Many times Mike would send cases back to the patrol officers for more investigation or agree that the "leg" work was not up to snuff or even that the officers overstepped their bounds in making the case.

So, a wonderful choice for the lucky citizens of JP Precinct #3 of Comal County.

Both men will serve the citizens well and both will make an excellent JP Judge.  Its a win/win situation for Comal County no matter which man gets chosen.

Incompetency

It sounds like someone, most likely the suspect, would have eventually come to harm.



Suspect in 2 cases ruled incompetent to stand trial
A 26-year-old Kerrville man accused of two counts of indecency with a child sexual contact has been ruled incompetent to stand trial and will go to the North Texas State Hospital in Vernon.

Jacob Smith remains in the Kerr County Jail awaiting transfer to the facility in North Texas.

Smith was accused of an incident April 30 in the 1300 block of East Jefferson Street, where a woman reported seeing a man expose himself near her yard, where she was standing with her young son. She told police the man, who she believed to be Smith, saw both of them looking at him and made no attempt to close his pants or cover himself.

Co-defendant gets 35 years for fatal robbery

A San Antonio man who had faced the possibility of execution for participating in a deadly convenience store robbery was sentenced Monday to 35 years in prison.

Theodore Joyner, 20, brokered a plea deal in August in which he agreed to cooperate with prosecutors in their upcoming death penalty trial against co-defendant Keith Dwayne Evans. In exchange, prosecutors agreed to change a capital murder charge to aggravated robbery and the 35-year term.

His sentencing was put on hold until after Evans' trial concluded. Evans was found guilty this month of killing popular East Side convenience store owner Mohammed “Moe” Omar during the August 2009 robbery. Prosecutors did not call Joyner to testify.

Death penalty sought against mother

Prosecutors announced Monday they will seek the death penalty against Elyse Marsyl Colon, who was arrested in February after police found her two sons, 1 and 3, stabbed to death in her North Side home.

Colon, 23, is charged with two counts of capital murder. Authorities said she called 911 and calmly waited for police in her front yard with blood on her arms.

“I just killed my babies,” she was reported to have said as police arrived.

Father accused of injuring sons

A man accused of beating his son with a belt and encouraging him and his brother to fight each other remained jailed Monday.

Robert Martinez, 31, was in Bexar County Jail on two counts of injury to a child with serious bodily injury. A judge set bail at $15,000.

An arrest warrant affidavit states a detective noticed bruises on Martinez's 12-year-old son while questioning him about a younger brother's injuries.

Facebook admits 'inadvertent' privacy breach

The admission follows a Wall Street Journal investigation which uncovered evidence that some popular Facebook apps have shared user data with internet tracking organisations.
 
The Wall Street Journal said the breach affects tens of millions of Facebook users, including those who have set their profiles to the most secure and robust privacy settings. Facebook insists the breach does not expose any private user information.

The Journal’s investigation found that all 10 of the most popular Facebook apps – including well-known games such as FarmVille, Mafia Wars and Texas Hold’em – transmitted Facebook user identities, known as UIDs, to advertising and internet-tracking companies, in contravention of the social networking site’s rules.

Facebook’s policies state that developers cannot disclose user information to advertising networks or data brokers, and that no one can access private user data without explicit user consent.

Cops: Prostitute called when 'John' didn't pay

CAMP WASHINGTON – Cincinnati police say a prostitute called them for help when her customer refused to pay for services rendered.

When the woman summoned officers to a Camp Washington motel on Monday night, she told them to get there fast because hostages were being held at gunpoint, according to Hamilton County court records.

But when police arrived, they arrested two women on prostitution charges.

Megan C. Taylor, 20, and Donna Toure, 34, were booked into the Hamilton County jail about 8 p.m. on charges of soliciting prostitution. Taylor faces an additional charge of inducing panic for allegedly making the phony report.

Both women also were wanted on open warrants for other, unrelated charges such as assault and child endangering, court records show.

Stupid is as stupid does

Alpharetta man regrets 'boneheaded' baggage carousel ride

A 40-year-old Alpharetta man who hopped on a moving luggage carousel at Miami International Airport and rode it into a secure area told the AJC on Friday that "it was just a dumb, boneheaded play."

Now Bradley Ray Bromelow is facing a trespassing charge and possible civil penalties from the Transportation Security Administration.

Bromelow caused a stir in the baggage claim area of Concourse J when he got on the carousel about 1:30 p.m. Thursday.

The Miami-Dade Police arrest report, obtained by WSVN-TV, stated:

"Bradley Ray Bromelow layed down on carousel belt #5 ... moving passenger luggage for arriving passengers. Bromelow proceeded on belt through open doorway to the airport operating area, while filming passengers watching him. Bromelow ... admitted trespassing into the airport operating area while 'showing off' in front of his friend."

In an interview with the AJC, Bromelow said it was a stupid prank he sincerely regrets.

Elementary student brings pot to school to turn in his parents

MATTHEWS, NC (WBTV) - Two parents are facing drug charges after their child took their drugs to school and told a school officer his parents were breaking the law.

WBTV is not releasing the names of the parents or the name of the school to protect the child's identity.

The 11-year-old student is in 5th grade at a an elementary school in Matthews.  Police say he brought his parents' marijuana cigarettes to school when he reported them.

Matthews Police say he reported his parents after a lesson about marijuana was delivered by a police officer who is part of the D.A.R.E. program, which teaches kids about the dangers of drugs, alcohol, and tobacco.
"Even if it's happening in their own home with their own parents, they understand that's a dangerous situation because of what we're teaching them," said Matthews Officer Stason Tyrrell.  That's what they're told to do, to make us aware."

Iraq jewelry store heists spark gunfights, 7 dead

— Iraqi police say two policemen and five others were killed in gunfights between security forces and armed groups attempting to rob Baghdad jewelry stores.

Police say two carloads of armed attackers attempted apparently coordinated robberies Sunday in western Baghdad's mostly Sunni Mansour neighborhood.

Gunfights broke out as security forces responded, killing the owners of all three jewelry stores, two gunmen and two policemen.

Two police officials gave the toll in the attacks, which was confirmed by a worker at Yarmouk hospital. All spoke on condition of anonymity because they were not authorized to speak to media.

BAGHDAD (AP) — Iraqi police and health officials say rush-hour bombings in Baghdad have killed a government employee and wounded five other people.

Police blamed bombs that were surreptitiously stuck onto cars for both explosions.

In the first, a hospital doctor and his driver were injured in the capital's downtown business district of Karradah around 8:45 a.m. local time. A bystander also was hurt in the blast.

Fifteen minutes later, a bomb hidden on a Ministry of Industry car in south Baghdad killed its driver and injured two bystanders.

Two police officials gave the toll in the attacks, and the deaths were confirmed by hospital workers.

All spoke on condition of anonymity because they are not authorized to brief the media.

No Hindu terrorists ?

Isn't pretty much anyone capable of being a terrorist?

Okay, except for the Hare Krishna's, but they can get pretty aggressive.


Terrorism, Hindus not related to each other

NAGPUR: The Rashtriya Swayamsevak Sangh has taken a strong exception to the use of the term 'Saffron or Hindu terror' and said that terrorism and Hindus cannot be related to each other.

Addressing the annual Dussera rally at Reshim Bagh ground, RSS chief Mohan Bhagwat said, "Terrorism and Hindus are the oxymoron and can never be related to reach other. This was an attempt to weaken the strength of the Hindus in India and at the same time to appease the Muslims."

Noted musician, Hridaynath Mangeshkar was the chief guest of the occasion.

A handful of incidents involving Hindus were reported and for that to blame the entire Hindu community was improper and unjust, Bhagwat said.

"Hindus are generally not involved in terrorism," he said.

Deaths result in religious controversy

Two tragic events have attracted public attention to the way the Jehovah’s Witnesses denomination operates in Russia. While members of the group allege discrimination by the government, many Russians, including religion experts, are hostile to the sect, believing it to be a totalitarian cult rather than a legitimate religious movement.

Last Sunday, a newborn died in central Moscow in the wake of a home birth gone wrong, RIA Novosti reported. Media reports claim that the mother, who was taken to hospital with severe bleeding, is a Jehovah’s Witness. It has been suggested in the press that the mother’s religious beliefs prevented her from calling for medical help in a timely manner.

Earlier this month, Interfax reported that criminal charges were brought against the mother of an 11-year old boy, Ilya, who died this August following a traffic accident. The mother, a Jehovah’s Witness, allegedly refused to allow a blood transfusion for her son.

“Based on the diagnosis, [Ilya] Orlukovich needed a blood transfusion,” Sergei Markov, a spokesman for the Investigation Committee at the Prosecutor’s Office, told Interfax. “But his mother repeatedly refused blood transfusion despite a deadly threat to the child.” The boy eventually died of blood loss, Markov added.

Jehovah’s Witnesses famously follow a religious doctrine that prohibits blood transfusion. Willing acceptance of a transfusion can result in expulsion from the sect.

Jehovah’s Witnesses deny any connection to the home birth case. “The woman in question [in the home birth situation] had nothing to do with Jehovah’s Witnesses,” Grigory Martynov, press secretary of the administrative centre of Jehovah’s Witnesses in Russia, told The Moscow News, adding that the organisation has called on media outlets to reconsider their reports of the home birth.

Commenting on Ilya’s death, Martynov played down the issue of blood transfusion, saying that Ilya’s mother Luydmila “demanded the best and most up-to-date treatment” for her son when he was brought to the hospital, but nothing could be done to save his life.

Some experts say that Jehovah’s Witnesses are still responsible for the tragedy. “The deaths of children occurred because of the Jehovah’s Witnesses religion, which with its destructive practices forces people to refuse medical assistance in the form of blood transfusion,” Alexanxder Korelov, head of the legal committee at the Russian Association of Centres for Religion and Sect Studies, told The Moscow News.

“This is especially dangerous when it concerns children,” he went on to say. “The ‘no blood’ principle propagated by the sect is not only based on a false and distorted interpretation of Holy Scripture, but also severely contradicts existing law that guarantees each person the right to full medical assistance.”

Over the last few years Jehovah’s Witnesses have found themselves under pressure from Russian authorities. In several Russian cities, including Moscow, Taganrog and Arkhangelsk, local divisions of their organisation have been shut down by court orders on grounds of instigation of religious hatred and extremism.

Last summer the European Court of Human Rights upheld the Jehovah’s Witnesses’ complaint about the closure of their Moscow branch and ruled that a compensation of 70,000 Euros be paid. Russian authorities have appealed the verdict.

“As far as court persecution of Jehovah’s Witnesses and accusations of extremism are concerned, this, unfortunately, is beginning to look like the persecution the Witnesses faced under the Soviets,” Martynov said.

Korelov strongly disagreed. “The Jehovah’s Witnesses sect was rightly labelled an extremist organisation because in its activities – all the signs of extremism are present,” he said. “The children’s deaths are just the most blatant example of the organisation’s destructive nature.”

Arson suspected in fire south of downtown

Arson is suspected in a fire that gutted an abandoned building south of downtown early Saturday morning, fire officials said.

No one was injured in the 2:15 a.m. blaze in the 300 block of South Presa Street, but the building was razed, said acting fire shift commander Brooke Hildreth.

She said no one was in the building, a home built in 1903, when firefighters arrived to find the structure fully engulfed in flames.

School investigates bare-bottom display
Woman accused of dropping pants on school grounds

ALBUQUERQUE (KRQE) - An argument over student drop-off zones outside an Albuquerque school heated up as kindergarteners watched until a woman dropped her drawers showing a mother what she could kiss, according to a parent who said she witnessed the incident.

The concerned parent, who asked not to be identified for fear of retaliation, said it happened around 9 a.m. on Tuesday at Alvarado Elementary School.

The parent said she was dropping off her daughter when a woman was spotted in the wrong drop-off area. An argument between the woman and another parent ensued. The concerned parent said the verbal disagreement grew louder and louder.

“Very loud, to the point where the crossing guard came up to see what was going on,” the concerned parent said.

The woman started shouting profanities and made it clear she was not leaving.
However, no one ever expected what happened next.

“She dropped her pants, fully exposing her buttocks and other areas; underwear and everything,” the parent said.

It did not end there. According to the witness, the woman then slapped her exposed rear end and told the other parent what she should kiss.

“Basically said kiss my *** and F-off,” the parent said.

The parent said it happened right in front of the kindergarten playground with kids, parents and even a crossing guard as witnesses. She said the woman bent over so far that she saw a lot more than just the lady’s rear end and so did her daughter.

“She proceeded to say, ‘Gross, Mommy. What is she doing?’” the parent said. “Very upset. I think that is what has got me the most is that school grounds are supposed to be protected grounds. That's where it's safe haven for children.”

Albuquerque Public Schools Police Department detectives are investigating. They said they do not know if the woman was a parent or a family friend. The concerned parent said even if the woman wasn’t a parent, she should have known better.

“There would be repercussions for students if they had done this,” the parent said. “We don’t get into a heated argument and take [off] our clothes.”

The concerned parent said APS detectives told her it is not a crime to expose one's buttocks, if that is all that is exposed. However, the parent claimed the woman did show more. If that was the case, she will face criminal charges.
APS police would not say if they have tracked down the mooner.

Another dead baby

Man, 20, charged in baby's death

A 20-year-old man faced first-degree felony charges Friday in the overnight death of his 2-month-old daughter.

Dominique Martez Reed was booked into Bexar County Jail under $250,000 bail in the death Friday morning of Zaniyah Reed, according to city magistrate's records.

Members of the multi-agency Lone Star Fugitive Task Force and the Converse Police Department took Reed into custody a little more than 12 hours after the early-morning incident.
